NOTICE TO THE RESIDENTS AND TAXPAYERS OF DISTRICT TOWNSHIP, BERKS COUNTY, PENNSYLVANIA PUBLIC NOTICE is given that the Board of Supervisors of District Township, Berks County, PA, will hold a public hearing, followed by a regular meeting of the Board of Supervisors on February 21, 2019 at 7:00 P.M. at the Township Building located at 202 Weil Road, Boyertown, Berks County, Pennsylvania. The purpose of the public hearing is to inform the public, and receive public comment or testimony regarding adoption of an Ordinance entitled: “AN ORDINANCE OF DISTRICT TOWNSHIP, BERKS COUNTY, PENNSYLVANIA ESTABLISHING REGULATIONS DEFINING THE MAXIMUM NOISE LEVELS ALLOWED; PROVIDING FOR CERTAIN EXEMPTIONS TO THE MAXIMUM NOISE LEVELS ALLOWED; PROVIDING FOR THE ADMINISTRATION AND ENFORCEMENT OF THE PROVISIONS OF THIS ORDINANCE; AND PROVIDING PENALTIES FOR VIOLATIONS.” At the conclusion of the public hearing, the Board will convene its regular meeting and intends to adopt this same Ordinance. Copies of the complete text of the Ordinance being proposed for adoption may be examined without charge, or copies may be obtained for a charge not greater than the cost thereof, at the District Township Municipal Building during Office hours of Tuesday and Thursday, 7:00 a.m. – 2:00 p.m. or by appointment with the Township Secretary, (610) 845-7595. A summary of the Ordinance is set forth below. All interested parties may appear and be heard. Susan Manwiller, Township Secretary A SUMMARY OF ORDINANCE NO. 2019-01 Section 1. Title: The title of the ordinance is “District Township Noise Ordinance.” Section 2. Authority. This ordinance is enacted pursuant to the Second Class Township Code. Section 3. Purpose. The Purpose of the ordinance is to promote the public health safety and welfare by regulating maximum sound levels and preventing excessive or offensive noise in the Township. Section 4. Background. Because excessive sound levels are detrimental to the health, safety and welfare of the residents of the Township of District and such levels: a) create a nuisance that may deprive residents of the enjoyment of their homes, disturbed in their sleep, and otherwise prevented from the quiet enjoyment of their residential premises; b) affect the property values of residences in the Township; c) affect the public welfare by reflecting negatively on the quality of life in residential areas of the Township; d) disturb the peace and good order of the Township; and, e) create noise pollution. Section 5. Terminology; Definitions. Phrases and words used in the ordinance are defined and explained. Section 6. Noise Limit. This section sets sound levels and times regulated by the ordinance. Section 7. Exemptions. This section exempts certain activities and sound levels from regulation. Section 8. Special Waiver. This section allows waivers from ordinance requirements during emergencies. Section 9. Enforcement Officers. This section identifies individuals authorized to enforce the ordinance. Section 10. Enforcement Procedures. This section describes the procedures for applying and enforcing the ordinance. It also declares that sounds in excess of those permitted in the ordinance is a public nuisance. Section 11. Conflict with Other Restrictions. This section states that the ordinance is not intended to interfere with other statutes and regulations and the more stringent law or regulation will control if there is a conflict. Section 12. Violations and Penalties. Conviction for violating this ordinance is a fine of up to $1,000.00 with each day considered a separate offense. Section 13. Severability. If any part of the ordinance is ever held invalid, the remaining portions of the ordinance remain in effect. Section 14. Effective Date. The ordinance is effective 5 days after enactment. The District Township Planning Commission Business Meetings will be held at 7:00 p.m. on the first Thursday of each month for the year 2019. The District Township Environmental Advisory Committee will hold their business meetings at 6:30 p.m. on the first Monday of each month for the year 2019 (unless that Monday is a holiday, then the meeting will be the following Monday). The District Township Recreation Committee will hold their quarterly meetings at 6:30 p.m. on the third Thursday of March, June, September, and December for the year 2019.
